Robert Berry is the co-founder and managing member of Berry & Maxson LLC. Since 1997, he has successfully litigated and arbitrated high-stakes business disputes and class actions dealing with a wide cross-section of legal issues. In 2007, he received the prestigious distinction of being named one of Southern California’s “Super Lawyers Rising Stars” by Los Angeles Magazine. In some of the nation's largest and most complex cases, Mr. Berry has defeated bet-the-company class certification petitions, obtained early dismissals, won summary judgment, and achieved success at trial. He has successfully affirmed awards on appeal and negotiated complex settlement agreements. He also guides and counsels his clients through times of crisis and when making critical changes in their business. He has developed pricing and sales policies, assessed the viability of proposed business transactions, managed contract negotiations, and obtained regulatory approvals for major energy companies, utilities, airlines, retail stores, manufacturers, 3PLs, and service industry clients. Among his other clients, Mr. Berry has represented:
- Natural gas and electric utilities against antitrust class actions brought on behalf of 23 million ratepayers seeking billions of dollars in damages and restitution;
- Major utilities against class actions brought under the Commodity Exchange Act;
- Numerous airlines against multi-million dollar RICO and fraud claims brought by a nationwide class of travel agents;
- Golf club manufacturer against Colgate-doctrine price maintenance action attacking nationwide new product introductory price policy;
- National retail pharmacy against a putative consumer class action relating to taxation of medical supplies;
- General partner of HUD-regulated property against derivative claims of limited partners;
- Limousine manufacturer against competitors for an alleged group advertising boycott;
- Banking computer software developer appealing order imposing a “head-start” injunction after jury finding of misappropriation of trade secrets;
- Board of Trustees against a beneficiary class's attempt to alter the method of calculating retirement benefits;
- Multinational enterprises seeking regulatory approval of proposed transactions from the Federal Trade Commission and Department of Justice.
Mr. Berry received his Bachelor of Arts degree magna cum laude from Boston College in 1993. He earned his law degree with high honors from Washington University School of Law in St. Louis in 1997, where he was a member of the Order of the Coif and the Washington University Law Quarterly. During law school, Mr. Berry served as a judicial extern to the Honorable Ronnie White on the Missouri Court of Appeals. Prior to founding Berry & Maxson LLC, he practiced law in the Los Angeles office of litigation powerhouse Gibson, Dunn & Crutcher LLP (2001-2007), in the Kansas City office of Spencer, Fane, Britt & Browne LLP (1999-2001), and in the St. Louis office of Lewis, Rice & Fingersh P.C. (1997-1999). Mr. Berry serves as the Chairman of the Board of the Exceed the Need Children’s Development Foundation.

Melinda Maxson is the co-founder of Berry & Maxson LLC. Since 1998, she has litigated a wide range of business and class action disputes, including claims for fraud, breach of contract, unfair competition, product defects and wrongful death. Ms. Maxson received her Bachelor of Arts degree summa cum laude from Boston College in 1995 and her law degree with high honors from Washington University School of Law in St. Louis in 1998. She was a member of the Order of the Coif and Washington University's nationally ranked mock-trial team. Carol M. Silberberg is the Manager of the Los Angeles office of Berry & Maxson LLC. Ms. Silberberg practices general business litigation, with a concentration in consumer class action and unfair competition matters. She has represented various clients in class actions, telecommunications, RICO, antitrust, and business litigation matters in both state and federal court. Ms. Silberberg received her law degree in 2001 from the University of Southern California, where she served as Senior Editor of the Southern California Law Review and was elected to the Order of the Coif. Ms. Silberberg's note, "Preserving Educational Fair Use in the Twentieth Century," was published in the Southern California Law Journal in January 2001 (74 S. Cal. Law Rev. 617). Following law school, she served as a law clerk to the Honorable George H. King in the United States District Court for the Central District of California. Ms. Silberberg earned a Master of Arts degree in Education in 1995 from the Claremont Graduate School and a Bachelor of Arts degree cum laude in English and History from the University of California, Los Angeles, in 1993.

David Baxter is an attorney with Berry & Maxson LLC. Mr. Baxter graduated from Wake Forest University with a Bachelor’s Degree in Political Science and Economics in 2006. While at Wake Forest, he was a member of the Pi Sigma Alpha and Omicron Delta Epsilon honor societies. He also spent a semester at University College London in England. Mr. Baxter earned his Juris Doctorate from Washington University in St. Louis School of Law in May 2009. While at Washington University, Mr. Baxter was a member of the Journal of Law and Policy and participated in the school’s Appellate Clinic, representing a client in the Eighth Circuit. Before joining Berry & Maxson, Mr. Baxter interned with the Alliance Defense Fund, worked as a research associate for Health Capital Consultants, and worked as a research assistant for Washington University School of Law Assistant Dean Mary Perry. J. Clayton Johnson applies his legal experience as a commercial litigator, an employee benefits attorney with several years of transactional experience, and a federal judicial clerk to the advantage of Berry & Maxson’s clients. His range of experience includes a variety of areas such as antitrust, ERISA, and class actions, and his previous practices include both complex litigation and significant transactional and legal compliance work.
Mr. Johnson received his law degree summa cum laude from Syracuse University College of Law where he was Editor in Chief of the Syracuse Law Review and a member of the Order of the Coif, and his Bachelor of Arts degree With Distinction in History from the University of Illinois at Urbana-Champaign. Before coming to Berry & Maxson LLC, Clay practiced law in the St. Louis office of Bryan Cave LLP (2002-2009), in the Kansas City office of Spencer, Fane, Britt & Browne LLP (1997-2002), as a judicial clerk to Hon. Deanell Reece Tacha of the United States Court of Appeals for the Tenth Circuit (1996-1997), and as a judicial clerk to Hon. Frederick J. Ravi K. Nangia brings business acumen and practical experience to the resolution of legal disputes at Berry & Maxson LLC. Before attending law school, Ravi worked for several years as a management and technology consultant with Cap Gemini (formerly Ernst & Young Consulting) and Accenture, where he helped Fortune 500 clients implement information technology solutions and refine their business processes.
Mr. Nangia received his law degree in 2008 from Washington University School of Law in St. Louis and his Bachelor of Science degree in 1996 from the University of Missouri, Columbia, in Business Administration - Finance and Banking. While in law school, Mr. Nangia was the recipient of the Judge Amandus Brackman Moot Court Prize, which is presented for outstanding success in moot court competitions. Mr. Nangia is a member of the bars of Missouri and California.

Jessica W. Kennedy is a commercial litigator with more than thirteen years of trial experience, both civil and criminal. Before coming to Berry & Maxson, Ms. Kennedy practiced in the area of general civil and commercial litigation with Carmody MacDonald P.C. in St. Louis (2005-2010), including employment and commercial cases and medical professional defense. Ms. Kennedy began her legal career as a prosecutor, working for the Office of the Circuit Attorney for the City of St. Louis (1998-2005) and the Office of the Prosecuting Attorney for St. Charles County (1997-1998). As a member of the felony trial staff at the Circuit Attorney's Office, she co-initiated and implemented the Circuit Attorney's Community Education Program, a 10-week education course for City residents. In fall 2004, Ms. Kennedy served as the acting Chief Warrant Officer for the City of St. Louis.
Ms. Kennedy received her law degree from Washington University School of Law in St. Louis in 1997. During law school, she interned with Legal Services of Eastern Missouri, the Missouri State Public Defender’s Office in St. Louis County, the Office of the Circuit Attorney for the City of St. Louis and the Office of the Prosecuting Attorney for St. Charles County, Missouri. Furthering her legal education, Ms. Kennedy attended trial programs focused on expert cross-examination of physicians and forensic scientists at the National Advocacy Center in Columbia, South Carolina, in 2001. Prior to attending law school, she worked as a VISTA volunteer for the San Antonio AIDS Foundation in San Antonio, Texas. She received her Bachelor of Arts degree in Political Science, with a minor in Spanish, from Newcomb College of Tulane University in 1992.
Ms. Kennedy is a member of the Missouri Bar and is admitted to practice in the U.S. District Court for the Eastern District of Missouri and the U.S. Court of Appeals for the Eighth Circuit. Ms. Kennedy is the Secretary of the Women Lawyers' Association of Greater St. Louis and is a member of the Bar Association of Metropolitan St. Louis and the Lawyers’ Association of St. Louis.
